Measure 13 – Payments to areas facing natural constraints or other specific constraints

Sub-measure: 13.1 – compensatory payments in mountain

1. Description of the action
This sub-measure is a tool which supports for agricultural land in areas where agricultural production is affected by climate and terrain conditions because of the altitude and slope of mountain areas and consisted of the sum of the areas of administrative territorial units (LAU 2 ) designated according to the following criteria:
– Administrative units located at altitudes larger or equal to 600 m, the limits of which are those of physical blocks (identified in the Integrated Administration and Control System);
– Administrative units located at altitudes between 400-600 m average and an average slope equal to or greater than 15%, the limits of which are those of the physical blocks.

2.Type support
Support under this measure is compensating. The first annual compensation is paid as a fixed amount paid per unit area (hectare) and as compensation for loss of income and additional costs incurred by farmers.

3. The beneficiaries of this sub-measure are: – active farmers.

4. Eligible expenditure
Will be represented by the first compensatory beneficiaries to cover the loss of income or additional costs incurred by farmers due to natural constraints occur in areas where they work.

5. Eligibility
– Aid recipient must fall within the active farmer
– User customer is a farming area in Romania, identified in the Integrated Administration and Control System (IACS), included in the eligible area for mountain defined under Art. 32 (2)
Regulation (EU) 1305/2013;
– Minimum area of the farm is 1 ha and eligible lots least 0.3 ha (where provided specific conditions the single area payment for certain types of crops, the minimum size of the parcel must be at least 0.1 ha);
– The beneficiary undertakes, on an annual basis, to continue farming on agricultural land located in areas affected by natural constraints

6. Not eligible for support:
– Agricultural land located in areas eligible for the practice of farming but is not influenced by natural constraints manifestation from investments (greenhouses, solariums, irrigated land, land drained) or production methods or farming systems that compensate manifestation natural constraints (land agricultural use as live
or intensive orchards).
– Agricultural parcels located in areas eligible, except for permanent grassland, which have a larger area of 50 ha, considering that due to their size, with normal farming or land productivity are offset loss of income or additional costs due to manifestation of natural constraints.

7. Amounts and support rates applicable
– Support under this measure has an intensity of 100%.
– In order to avoid overcompensation, the amount of support is 80% of the income foregone and additional costs quantified by applying the methodology of calculation. For the mountainous areas of the allowance is 86 euro / ha / year (80% of loss of income and additional costs estimated at 108 euro / ha / year).
– For farms with agricultural land larger than 50 ha, the amount of agricultural land falls for those who exceed this value.

Sub-measure 13.2 – Compensatory payments for areas facing significant natural constraints

1. Description of the action
Sub-measure is a tool which supports for agricultural land in areas where agricultural production is less quantitatively and / or qualitatively due to unfavorable natural conditions

2. Type of support
Support under this measure is compensating. The first annual compensation is paid as a fixed amount paid per unit area (hectare) and as compensation for loss of income and additional costs incurred by farmers.

3. The beneficiaries of this sub-measure are: – active farmers

4. Eligible expenditure
Will be represented by the first compensatory beneficiaries to cover the loss of income or additional costs incurred by farmers due to natural constraints occur in areas where they work.

5. Eligibility
– Aid recipient must fall within the active farmer;
– User customer is a farming area in Romania, identified in the Integrated Administration and Control System (IACS);
– Minimum area of the farm is 1 ha and eligible lots least 0.3 ha (where provided specific conditions the single area payment for certain types of crops, the minimum size of the parcel must be at least 0.1 ha);

– Agricultural parcels located in areas eligible, except for permanent grassland, which have a larger area of 50 ha, considering that due to their size, with normal farming or land productivity are offset loss of income or additional costs due to manifestation of natural constraints.

7. Amounts and support rates applicable
– Support under this measure has an intensity of 100%.
– In order to avoid overcompensation, the amount of support is 80% of the income foregone and additional costs quantified by applying the methodology of calculation.
– For other areas facing significant natural constraints level of the allowance is 54 euro / ha / year (80% of loss of income and additional costs estimated at 68 euro / ha / year).
– For farms with agricultural land larger than 50 ha, the amount of agricultural land falls for those who exceed this value, the table in Annex 8.2.M.13-3.
– If after applying degressivity, the value of the allowance / ha would reach a level below 25 € / ha, the compensatory payment paid per unit area will be in the amount of € 25 / ha.

Sub-measure: 13.3 – Compensatory payments for areas facing specific constraints

1. Description of the action
This sub-measure is a tool which supports for agricultural land located in the administrative-territorial units or partially overlapping with the Danube Delta Biosphere Reserve.

2. Type of support
Support under this measure is compensating. The first annual compensation is paid as a fixed amount paid per unit area (hectare) and as compensation for loss of income and additional costs incurred by farmers

3. The beneficiaries of this sub-measure are: – active farmers.

4. Eligible expenditure
Will be represented by the first compensatory beneficiaries to cover the loss of income or additional costs incurred by farmers due to natural constraints occur in areas where they work.

5. Eligibility conditions
– Aid recipient must fall within the active farmer;
– User customer is a farming area in Romania, identified in the Integrated Administration and Control System (IACS);
– Minimum area of the farm is 1 ha and eligible lots least 0.3 ha (where provided specific conditions the single area payment for certain types of crops, the minimum size of the parcel must be at least 0.1 ha);

– For other areas facing specific natural constraints of the allowance level is 70 euro / ha / year (80% of loss of income and additional costs estimated at 88 euro / ha / year).
-If Farms with agricultural land larger than 50 ha, the amount of agricultural land falls for those who exceed this value, the table in Annex 8.2.M.13-3.
– If after applying degressivity, the value of the allowance / ha would reach a level below 25 € / ha, the compensatory payment paid per unit area will be in the amount of € 25 / ha.
